September 3, 2013
On this date I was
assigned this case and it involves a shooting that occurred in a field off of
Quattlebaum Road. The incident occurred on September 1,
2013 and occurred shortly before 7:20 PM. The
first 911 call was received at 7:20
PM from Josh Yandell claiming his brother Justin Yandell
had been shot in the knee.
Inthe first 911 calls
from Josh Yandell
you can hear screaming and Josh claiming
that he was being held at gun point while trying
to provide aid to his brother . During the 911
calls you can hear Josh Yandell
stating that his Dad is pulling up and you hear another altercation. It is difficult to understand everything that is
being
said on the calls due to
the screaming and the dispatchers
trying to gain control of the situation and gather information. The dispatchers are able to obtain the name Skip Doty as one of the three
unknown people involved in the incident. Shortly after this Josh Yandell says he can hear sirens
and law enforcement arrives.
Deputies
arrived on scene and made
contact with Mr. Jerry
Yandell who is
Josh and Justin Yandell's
father. Jerry Yandell led deputies to his son
Justin who was lying in a field with a
gun shot wound to the knee. Deputies
loaded Justin Yandell in his
fathers side by side ATV and took him to the ambulance so
that he could receive medical treatment.
Once
medical treatment had been given deputies tried to secure the scene and began investigating the incident. They discovered that the
other party involved was George Doty (Skip), his son Adam Doty,his son-in-law Jesse Wood, angrandson
The other party consisted of Justin Yandell who was shot in the knee, his brother Josh Yandell, and their father Jerry Yandell

Deputies obtained
written statements from the individuals involved in an attempt to figure out what happened . Deputies learned that
Adam Doty shot Justin Yandell in the leg with his fathers 9mm pistol. When they arrived on scene and made contact with Adam Doty he identified himself as the shooter.
Adam Doty was presented with a statement
of rights form and waiver that he read and signed that he understood. He then provided a written
statement claiming he shot Justin Yandell out of
fear for his life and his families
.
After reviewing the statements that were obtained from both families I was able to determine the following about the
incident.
The incident started when
Josh and Justin Yandell went to investigate some people hunting on their
neighboring property. All three of the Yandell's claim that they were out side
letting their children play when they started hearing gun shots and the shot falling on their house, shop, and vehicles. Josh
stated that he was unarmed and Justin stated that he was armed
with a ruger 9mm pistol that he had in a holster tucked in his waist band.
Physically Impossible for shot to hit there property!
They made contact
with
two people who were
hunting, Jesse Wood and
his son-

At this time Josh Yandell takes his
kids back to
the house leaving Justin talking to the hunters. Justin and Jesse's
statements both state that questions where asked over
the land and ifthey had permission to hunt it. At this time Jesse Wood tells Justin Yandell that he is family with the land owners, Skip and Vivian Doty, and that Skip is across the field hunting.
This is where it should have all ended, if in fact it was an issue
about shooting angles they told Jesse and there was no need
in going further problem solved but that's not what this was about!

This
is where the statements begin to differ. All statements claim
that Justin walked across the field to speak with Skip Doty. Jesse Wood states that when be mentions Skip to Justin that he becomes furious and is
determined to see him. Justin claims that he wanted
to have words with Skip Doty
and when he walked across the field
toward Skip he disarmed
himself so they could see it approximately fifty yards from them.

Justin states he
then
continued to approach Skip
Doty and his hunting
partner, Adam Doty. When Justin approaches he asks which one is Skip
Doty and then tells them that "you
may not remember me but I remember you". Itis
believed that he is referring to a previous hunting incident that occurred several
years ago. Justin states that when he says this they point
their guns at him and he gets struck
in the head.
At this point is when he pulls his gun and Adam disarms him!

Skip, Adam, and
Jesse claim that when Justin says this he reaches for his gun that is tucked in his shorts behind his back. At this time Adam Doty strikes Justin in the head with his
shotgun and then he and Justin struggle for the shotgun. Justin is able to take the gun
from Adam and Justin claims that he had a hold of it by the pump in his left hand and
had his other in the air trying to get them to stop. Justin claims
he was backing away when Adam Doty pulls a pistol and shoots him in the leg. The Doty's claim that when Justin gained control
of the shotgun he tried to turn it or point it at t4em so
Adam shot him in the leg.
Justin Yandell Had Adams shotgun in his hands readying it to shoot us when he was shot! I was squeezing the trigger on Justin Yandells head when Adam dropped him from my gun sights! ;

When Justin is shot he falls to the ground and he claims that Jesse Wood walked up to where he
left his pistol and
took it.
Justin states that he asks them to call to 911 and asks
them
what they are doing because they start picking up their things. He says they even tell him no one is calling 911. George Doty told
me that he was trying to tell Justin
to be quiet because his yelling was
going to make his family mad and things would get worse.
I told Jesse to take Triston to the truck and to call 911,The first thing that I did when it was determined Justin Yandell was no longer a threat was to see how bad he was injured, when I was about to kill him it was because I had no other choice, when he wasn't a threat I became once again someone who cared about other people, I examined his wound and determined it to be a glancing shot it was NOT BLEEDING! I was wrong it had entered the center of his knee cap and exited the back of his knee, bare legged but NOT BLEEDING! he began Screaming for his brother, I told him that we were calling 911 and an ambulance and police were on the way, please do not get your brother down here and get him shot too because if he comes with a gun we will have no choice!

Statements
are very different. No
one calls 911.
Different because Justin Yandell was lying! As far as I knew Jesse and my grandson were calling 911, they claimed at trial all these different times and stated that josh called first, I have listened to the tapes since the trial and on the tapes that I will be posting you can hear my grandson , and myself talking to 911 simultaneously with Josh Yandell!
Josh Yandell stated he heard the shot as he was walking off his porch back toward Justin. He states he ran to the fence yelling his brother's name but he couldn't hear him. He states that he runs down toward his brother and as he is running he can hear him screaming. There is a large cedar tree near where this incident took place and Josh states that when he runs around the tree and can see Justin and that George Doty, Adam Doty, and Jesse Wood all point there shotguns at him. He says they are yelling at him that they will shoot him and asking if he is armed. Josh Yandell says he yells that he is unarmed and runs to his brother while the Doty's hold him at gun point. He says he reaches for his pocket to get his cell phone and call 911 and when he does Adam Doty puts the pistol in his face screaming he will kill him. Josh is the first person to call 911 after running from his house across a large area to where his brother was laying.
Further proof that it was impossible for our shot hitting there residence, trees a hill and distance would prevent that from ever happening, we did point our guns at Josh Yandell totally expecting him to have a gun when he reached in his pocket anyone that wouldn't have thought the same thing after what we had already been through.

During Josh Yandell's first 911 call he gets disconnected and between his conversations with Dispatch he gets a hold of his family and they tell his father, Jerry Yandell, that Justin has been shot. Jerry Yandell gets on a side by side ATV and drives down to where his sons are at. It takes Jerry Yandell several minutes to drive down but he states that when gets to the field he sees the three men standing over his sons pointing guns at them. Jerry Yandell states that he is driving the ATV very fast and he tries to run the men over because he sees them threatening his sons. He says he slides the ATV up to where his sons are and sees that Justin's injury does not look life threatening .
Shortly
after this Jerry Yandell and
George Doty get into
another altercation and
struggle over his
shotgun. During this
Adam Doty goes over and
points the pistol
at Jerry Yandell
threatening to kill him. This
altercation occurs while Josh Yandell is
on the phone
with 911 and you
can hear screaming but it is unclear what
is being said. .
During this altercation
is when Jesse Wood andlillllwalk back to there vehicle. When
he walks back to the truck
he takes his shotgun he was hunting
with and
Justin's pistol. After this point things start to calm down and law enforcement arrives.

This is where someone needs to help me understand how a crime was committed after the crime was committed making the original crime not the object of the Crime!
The Crime was Committed when Justin Yandell crossed the fence with a gun pulled it on me to shoot me, we shoot him in self defense and the states entire case is based on who called 911 first? Having to shoot this Son of a Bitch in self defense is NOT a Crime!

On this date I received a telephone call from Mr. Josh Yandell who informed me that he had received a call from Mr. Berry Reynolds. Mr. Yandell told me that Mr. Reynolds claimed to have witnessed the entire incident and he provided a phone number for him.

I called the number and made contact with Mr. Reynolds
who stated that he watched the whole thing take place. I asked him I could speak with him inperson and then drove to his residence. I met with Mr. Reynolds and he told
me that he saw the incident through a pair of binoculars. He pointed out
to a field that can be seen from his front porch and told me that everything happened close to the large cedar tree that I could see.

He stated that he was watching the people who were over there hunting and he saw a young man, Justin Yandell, walking up to
the hunters. He told me he saw Justin take
something out of his waistband and set it on the
ground but he couldn't
tell what it was. He said Justin then walked up to some of the other hunters
and he recognized one of the hunters to be
George Doty. Mr. Reynolds said that Justin walked up to George Doty and
the other hunter and walked up with his hands up. He said when he got up to
them he put his hands down and then one of the hunters who was wearing a blue shirt (Adam Doty) struck him with a shotgun.
He told me at that time
Justin and Adam struggled for the shotgun and that
Justin ended up taking it away from the man. He said Justin had the shot gun in one hand by the pump or the barrel with the barrel pointed in the air
and his other hand was up in the air. He
told me that Justin was backing up with his hands in the air when he heard the shot and saw Justin fall. He
said the guy in the blue shirt had a pistol and he thought they had killed Justin.
Mr. Reynolds said the one thing
he knew for sure was that Justin was not
a threat to them and he
did not deserve to get shot. I asked Mr. Reynolds about his relationship with both
groups and he told me that the only dealings he had with the Yandell 's was when Josh Yandell took his car without his permission two years ago. He told me he hadn't talked to them since and he didn't really get along with them. He also told me
that some land owners in the area have had
problems with George Doty. Mr. Reynolds was scarred
that George Doty would find out that he saw everything and that he would retaliate against him for talking with me. Mr. Reynolds then provided a written statement about the incident and what he saw.

On this date I met with Mr. Justin Yandell at the
hospital. During my conversation with Mr. Yandell I informed him that Mr. Reynolds had come forward as a third party witness. I asked him about the incident and I told him it was very important the
he tell the truth.
He stated he was being one hundred percent honest about what
happened. I showed Justin 3 photo line ups and he was able to
identify Adam Doty as the person who shot him. He was also able to identify George Doty and Jesse Wood.
I also spoke with Jerry Yandell who is
Justin's father and was also involved in the incident. Jerry Yandell told me that
the land where the incident took place belongs to Clayton Quattlebaum not the
Doty's. Mr. Yandell stated that for several years he has helped the Quattlebaum's take care of the farm and the cattle that are on it. He told me that
recently they have had some problems with people night hunting on the property
and that recently one of the farm animals wound up injured so they had been helping keep people run off the property. Mr. Yandell felt like it was very
important that I know who owned the property and that for some time they have
had permission to be on it. Mr.
Yandell stated he was
willing to pay for a survey to prove what land this happened on. I took Jerry
Yandell to a different area of the room away from Justin and showed him a different copy of the same photo
line ups I showed Justin. Jerry Yandell was also able to identify all three men
and when he identified Jesse Wood he told me that he saw him carrying Justin's pistol while he walked back to his vehicle.
During my conversation with Justin
Yandell I asked him why he disarmed himself before walking down to George Doty. He told me that everyone there had shotguns
and he knew he didn't stand a chance if something went wrong so he wanted to make it clear that he wasn't looking
for a fight. He also stated that Jesse Wood followed behind him and was
telling him you better not go down there
He claimed we were pelting his house with shot from our SHOTGUNS!! and THEN he went in his house and got his gun, how stupid is this seriously Folks?

I asked Justin if Jesse saw him lay the pistol down and he said yes that he followed right behind him and
that he was the one who
walked back up there and picked it up after
he got shot.
After I spoke with Justin I drove back out to Quattlebaum Road and met with Berry Reynolds. I had him show
me where he was standing when he witnessed the incident. He asked me if I would be mad if he was
trespassing on Quattlebaum ground when he witnessed this and I told him I just needed to know where he was at. I
took my camera and Mr. Reynolds took me to an area about 75 yards from where the shooting occurred . He told me when he saw Justin
walking across the field he ran down to this spot so he could see what was going on. He stated he did have his binoculars
and that he could see everything very clearly.

I marked the spot where Mr. Reynolds stated he was and had
him show me where Justin and George Doty were standing. He showed me where they were and I had him and Detective Chancey
Warden stand in that spot while I took some
photos. Detective Warden held his hands in the air like Mr. Reynolds claimed
Justin did and I took photos from where Mr. Reynolds
was standing.
I Believe this all happened after the 19th of September, the prosecution sent the case back to the detective after his original filing and charges were not pressed until the 30th.

When I returned to the office
I called and spoke with Mr. Jesse Wood. I told
him I had some questions I needed to ask him and I asked if he could come to the Sheriff s Office. Mr. Wood wanted to know what
questions I had and why I couldn't answer them with
his statement. I told him I had some
questions about when he followed Justin across the field and his gun. When I
told him that he got defensive and told me he didn't know he was under investigation. He said when he provided the statement he was
trying to help and didn't know that it was going to hurt him because he hadn't been advised of his Miranda rights. I had to explain to Jesse that Miranda only
applied to in custody interviews and that he was never under arrest so it
didn't apply. I told him I still needed to ask him the questions and asked what
time he could be here. He then agreed to come in at 4:00 PM.
Jeff Williams Threatened Jesse Wood to come and make a statement in contradiction to his original statement he threatened to put him in prison if he didn't come and do it, when I and my wife heard this we immediately retained Bryce Brewer to represent Jesse, This was the first sign of what a corrupt piece of shit Jeff Williams is!

I had discovered that Jesse Wood was a convicted felon and
had a previous charge of being in
possession of a firearm. I also knew that if he followed Justin he would have been the closest person
to him and
would have had
the best view of
Justin putting down the pistol. At 4:00 PM Jesse didn't show up so I called his phone
several times. He never answered his phone
but at 4:27 I received a call from
Mrs. Vivian Doty who told me that Jesse would not be coming in to see me and that
they hired him a lawyer. I asked Mrs. Doty
who his lawyer was and she stated it was Brice Brewer and she provided a phone number of I called and spoke
with Mr. Brewer who would not agree to come in with his client for any questions.
This was a lie, Bryce Brewer agreed to a meeting without threat!

At this point
in the
investigation Berry Reynolds identifying himself
as a witness was a key point in the investigation. I tried to find any past history between
Mr. Reynolds and the Doty's.
I even
questioned Mr. Reynolds and
the Yandell 's about their relationship with one another. I was not able to find
anything but on this date I was told by Mrs. Gail
Stokes who
is the White County Sheriff s
Office Criminal Investigation Division Secretary that there may have been a civil law suit at one time between Mr.
Reynolds and George Doty.
I went the Court
Clerks Office and spoke with Mrs. Glenda Kersh who keeps the records
for Civil Court. I asked
her
if she
had
any record of a claim against either person.
The case where Berry Reynolds was trying to steal our land was between his mother and father and my mother in law and my wife I was not listed nor was he in the case! Mrs. Gail Stokes is the Cousin of Berry Reynolds she knew this had happened and was telling the truth!

As ofthis date I have found that the Doty's statements do not match the evidence that has been found in this case.
Justin claimed his pistol never came out of the holster and that he set pistol and
holster together on the ground. That matches the evidence
since the Doty's had his pistol and
holster.
We had the pistol and the holster because they both came out when he drew his weapon and in the ensuing struggle, I unloaded it myself and put them together to give to the police! When Jerry Yandell attacked us Justin's dad it was Justin's Pistol that was lying on the ground that Adam pointed at them to make them release me when they were trying to get my shotgun!

Adam Doty claimed that Justin pulled
the pistol from behind his back when he hit him
and he dropped the pistol. This never made since due to the type of holster it
was in. It would have been very difficult to
pull the pistol from the holster behind the back and Adam's statement is not
clear about if
it was still in the holster or not at this time and his statement is written to
sound like Justin's action was a threat. Ifthe pistol was out of the holster why did the Doty's pick up his pistol and holster and not just the pistol.
If a man reaches behind his back and pulls a gun why would you NOT consider that as a Threat? Justin Yandell was enraged when he came down that hill to me, anything he did could have been considered a Threat!
Now this right here is possibly the dumbest thing I have ever heard and if you own a weapon and or carry a weapon or train with one, everything Jeff Williams says its just STUPID!!!

The only story without a bias side is Berry Reynolds witness statement.
His statement is very close to Justin Yandell's side of the story and supports
all the important details. It also
supports that when Josh Yandell
ran to aid his brother
George Doty, Adam Doty, and Jesse Wood held him at gun point and threatened to shoot him. He also witnessed when Jerry Yandell arrives on the ATV and he is
held at gun point and threatened.

On this date George and Vivian Doty came to the Sheriff s Office to speak about this
case. I met with them and they wanted to know
why the other parties involved had not been
arrested. Mrs. Doty wanted to know why I haven't
scheduled an appointment to meet with them and
there attorney or returned any of their
attorney's calls. I told
Mrs. Doty that I have not received any call
from their attorney and that
I haven't spoke with him since I called and talked to him about Jesse. Mrs. Doty stated that those men trespassed on to there property and tried to kill her husband and we were not doing anything about it. I asked Mrs. Doty if the land belonged to them or Clayton Quattlebaum and she stated it belonged to them and she could produce the deed. I asked her if she
was sure that plot belonged to them because the map showed they owned one south of where the incident took place and she was unsure.
Look at the date Folks! I had made multiple attempts to talk to Jeff Williams, my wife and I went to speak to the Sheriff, and by pass this guy who didn't seem to care about what we had gone through, only they sent us to his office and he asks what can I do for you? I asked him why he hadn't returned my calls or those of Bryce Brewer, he said he was waiting on Bryce to call him back, I asked him what was going on with the case and he says well I cant arrest him for trespassing because he was not on your land, I said I really didn't care if he arrested him for trespassing I wanted him arrested for trying to kill me, he said well he didn't have a gun, I will admit I did get mad when he said this, I told him "he not only had one gun he had two" one he brought and the other was my sons shotgun he was trying to shoot us with when he was shot, I said it in a very loud voice, he became irate jumped from his seat slamming it against the wall knocking stuff off the wall and said get out of my office I don't have to listen to this shit, I said you damn sure do have to listen to me because you are a servant of this county and I pay taxes so you work for me, you are treating us as the criminals and them as the victims, I told him I wanted all of everything he had so I could take it to the state police, he said file a foia I did that and never got a thing because they always claimed the case was still open!
Look at the date Folks! I had made multiple attempts to talk to Jeff Williams, my wife and I went to speak to the Sheriff, and by pass this guy who didn't seem to care about what we had gone through, only they sent us to his office and he asks what can I do for you? I told George Doty that I had some questions about there statements and what actually happened that day. He started to get upset when I said this and told me that there I had three witnesses that told us what happened and we weren't doing
anything about it. I told him I found some discrepancies in there statements about the pistol
that Justin had. I told him that if Jesse Wood would have come in to speak with me that I bet
he would have
told me that
Justin set his pistol down up by the tree. He then got very aggravated and
irate and started getting very loud with me in my office. I told them our meeting
was done and I asked them to leave. Mr. Doty
wanted the report and all his
information and demanded
to speak to the Sheriff. I told him to fill out a freedom of information request at the front window and set an appointment
to see the Sheriff.
As the evidence shows from this day forward Jeff Williams made the decision to show me and everyone else who the boss was, show us how much power he had to ruin someone's life because he got pissed off. There is no form of life any lower than a man who took an oath to the Constitution to use and abuse his power of authority over another man, he is the lowest of low a form of evil that destroys peoples lives because his ego got bruised, because someone chose to speak up against this bully piece of shit!

At this time this case meets the statutory requirements for a warrant of arrest. This case will be forwarded to the White
County Prosecuting Attorney's Office for review of criminal charges in violation of the Arkansas Criminal Code.

I just want to state one thing all of the statements we made Jesse Adam Triston and Myself happened immediately after the incident, we were all in shock and dismay I think we did a damn good job considering the circumstances, the Yandells and Berry Reynolds had several days to sit around and talk and make up a bunch of lies before they made there statements!
